1. Signing Up to be an onFlyFishing Reseller
If you agree to these terms, you can get started right away. Complete our signup form.
After we receive your application, you will be assigned a private account number and password. Whenever someone orders an onFlyFishing Advertising Package or service from your personal business page, you'll automatically be sent an email notice. You can also check your commission status and Web site traffic stats online at any time.
2. Reseller Web Site Approval
Criteria
We welcome the right kind of sites, but we cannot approve every single application. We cannot accept applications from sites that are:
- Violent in nature
- Adult-oriented or sexually explicit
- Illegal, or promote borderline-illegal activities
- In violation of copyright
- Inappropriate for onFlyFishing to be associated with!
We do expect to approve most applications, so please don't worry about this approval process unless you fall into these categories.
3. Our Policy on Spam
Please Don't! We want you to succeed every legitimate way you can, and we provide the ad copy, banners, marketing tools and support services to make your association with onFlyFishing a profitable success.
But - we do not tolerate at all spam email or spamming of the search engines, both of which ruin the Internet for honest, hard-working businesspeople worldwide. Here's why:
Most people today are offended and annoyed by unsolicited commercial email messages. Spam messages literally waste the resources of the Internet and severely downgrade the Internet environment. Most ISPs deny access to domain names which are known to permit the use of spam. Our Web hosting company does not permit the use of spam in association with any domain hosted by them (including the ONFLYFISHING.COM domain), and we are in full agreement with this policy.
Therefore, because any spam email message which references our domain in any way whatsoever jeopardizes our Web sites, our online endeavors and the income potential of our resellers, we take this firm stance:
If you are found to be spamming in any way, shape or form on behalf of your association with onFlyFishing, your account with us will be terminated immediately, any money owed you will be forfeited, and the Internet watchdog SpamCop will be contacted that same day with your complete information. Additionally, you will be held personally financially and legally responsible for any resulting loss of income that results. If you spam, we will literally take you out.
So please don't do it. Your reputation online is everything, and ours is, too.
4. The Term of this Agreement
The term of this agreement begins at the time you're accepted as an onFlyFishing Reseller.
Either party may terminate this agreement, for any reason and in their sole discretion, upon written notice of termination delivered via mail or email.
Upon termination of this agreement, the former Reseller must remove all onFlyFishing Reseller links and graphics from their Web site, and refrain from publishing same in any manner whatsoever.
We cannot be held liable, for any reason, due to failures or outages of our Web site, or of the Internet in general.
5. Money
The following terms and conditions have been added to allow us to better maintain
for you a quality Reseller Program:
- Our Reseller Payment to you is a percentage of the gross amount that the person you referred spent online at our Web site - after following your personal onFlyFishing business link to our Web site.
- You can double your commissions to 20%. Just as soon as you get your 1st 20 Advertisers, you will get a Commission INCREASE from 10% to 20%. This 20% commission 'jump' is automatic and retroactive.
Here's how it works:
You are paid 10% for your personal referrals right away, but will automatically be paid 20% for each and every Advertiser just as soon as you sign up your 1st 20 Advertisers. As long as 20 or more of the Advertisers you have personally brought to onFlyFishing continue to advertise with us, you will continue to earn 20% for each and every one of them.
Please know that this 20% commission is for every single Advertiser you bring to onFlyFishing. You will continue earning this 20% commission month after month for as long as at least 20 of these Advertisers remain customers of onFlyFishing.
- You do understand and agree that you are acting as an independent contractor and as such will be responsible for your own taxes and any other tax liabilities that affect the sales of our product in your state and country.
- An e-mail notification will be sent to you automatically whenever an onFlyFishing Advertising Package purchase is made. You can match these notifications up with the commission report for your personal account, which is posted online.
- We don't send payment for less than US $20.00. If this agreement terminates with less than US $20.00 accrued in Referral Payments, which are lifetime commissions and accrue every month, then no monies are due the former Reseller.
- We will not make a Reseller Referral Payment for any transaction for which payment has not been fully received, or for any transaction that has been rejected for any reason.
- When US $20.00 has accrued in Referral Payments, these commissions earned by and due to the onFlyFishing Reseller will be paid on a monthly basis, within two weeks following the end of each month.
- We are never responsible for paying any interest to the onFlyFishing Reseller for accrued but not yet delivered Reseller Referral Payments.
- If the transaction incurs a chargeback, or if the online transaction is not completed in every way, no Referral Payment is due to the Reseller. If one has already been paid, then it will be deducted from an active onFlyFishing Reseller's accrued Referral Payments. Otherwise it will become due immediately from the Reseller (or former Reseller).
6. Modification of this onFlyFishing Reseller Agreement
This agreement may be modified at any time by us, at our sole discretion, by modifying our Web site. You will receive timely e-mail notification of any such modification. Continued participation in the onFlyFishing Reseller program constitutes an agreement with its then-current rules and information, posted publicly on our Web site.
